TERMS AND CONDITIONS

 

1. General Information

 

These Terms and Conditions (“Terms”) govern your use of the Dalmatino website (“Website”) operated by Dalmatino Real Estate (“we,” “our,” or “us”). By using our Website or making any reservation or payment through it, you agree to comply with these Terms.

 

2. Reservation & Purchase Process

2.1. By making a reservation payment, you reserve the selected land plot.

 

2.2. Upon payment, you will receive a Power of Attorney (POA) document by email, authorizing us to act on your behalf to complete the legal transfer of ownership.

 

2.3. The legal transfer of property ownership is finalized upon the signing and notarization of the purchase contract. Until then, you hold a confirmed reservation right only.

 

3. Pricing & Payments

3.1. Prices listed on our Website are per square meter and serve as reservation deposits for each property. The exact price per m² varies by property and is clearly displayed on the product page.

 

3.2. Payment processing is handled securely via Stripe. By providing your payment details, you agree to Stripe’s processing terms.

 

4. Promotional & Affiliate Programs

 

4.1 We may run promotional campaigns where customers can apply discount codes for up to 10% off selected land reservations.

 

4.2 Certain discount codes are provided through our affiliate program. When a customer uses a valid affiliate code, the associated affiliate may receive a commission for the reservation payment.

 

4.3 Commissions are paid only after the payment is confirmed and are handled via Stripe payouts. Affiliates are responsible for any applicable taxes or reporting obligations in their jurisdiction.

 

4.4 We reserve the right to change, pause, or discontinue affiliate payouts or discount offers at any time without prior notice.

 

5. Non-Refundable Reservation

5.1. All reservation payments are non-refundable once confirmed, except if we are unable to complete the legal ownership transfer due to circumstances solely within our control.

5.2. In the event we cannot fulfill the property transfer, your reservation payment will be fully refunded.

 

6. Legal Ownership Transfer

6.1. Ownership transfer will require the buyer’s cooperation, including signing necessary documents, submitting identification, and notarizing documents.

6.2. Failure of the buyer to cooperate timely in the above requirements may result in cancellation of reservation without refund.

 

7. Limitation of Liability

7.1. Our liability is limited to direct damages and shall not exceed the amount paid by the buyer. We shall not be liable for indirect or consequential losses.

7.2. We assume no responsibility for any delays or failures caused by third-party service providers, such as payment gateways or notaries.

 

8. Intellectual Property

All content on our Website, including text, images, logos, and software, is our intellectual property or licensed to us. Unauthorized use of any materials is strictly prohibited.

 

9. Dispute Resolution

Any disputes arising from or relating to these Terms shall be governed by the laws of the Republic of Croatia. You agree to the exclusive jurisdiction of Croatian courts for dispute resolution.

 

10. Amendments to Terms

We reserve the right to amend these Terms at any time. Updated Terms will be posted on our Website. Continued use of our Website after changes implies your acceptance.

11. Eligibility

Our services are available exclusively to citizens and residents of the European Union (EU). By completing a reservation payment, you confirm that you are a citizen or legal resident of an EU country and meet this eligibility requirement. We reserve the right to cancel any order that does not comply with this eligibility rule. If an order is canceled due to ineligibility, a refund may be issued minus any applicable processing fees.
